General Terms and Conditions of Sale

Generality

The following provisions establish the general conditions of distance selling on the Italian territory of the products offered, through the website www.marcellofontanashop.it by the company Marcello Fontana, Via Mercato Vecchio, 2 - 80049 Somma Vesuviana (NA), VAT number 08167611212 (hereinafter Marcello Fontana Shop). Marcello Fontana Shop retains full ownership of the products until delivery and collection of the full price, expenses and taxes included. The sales process through the website www.marcellofontanashop.it was carried out in full compliance with the legislation on distance selling and in particular with articles 50 and following of the Italian Consumer Code Legislative Decree n. 206 of 6 September 2005. The use of the distance selling process described in these general conditions of sale is reserved for consumers (hereinafter "the Customer" or "Customers" or "Consumers") who act on their behalf and resident in Italy. The execution of the purchase order through the website www.marcellofontanashop.it implies total and absolute prior knowledge of these general conditions of sale and their full acceptance. These general conditions of sale are to be considered applicable and in force as long as they are accessible from the website www.marcellofontanashop.it. The products are offered for sale in Italy. Only available products can be ordered with the exception of promotional offers with a certain duration. In this case, the Consumer must pay attention to the time limits of validity of the offer. In the event of a dispute arising from this contractual relationship, the parties undertake to seek, before any legal action, a solution dictated by common sense. In compliance with articles 52 and 53 of the consumer code, Marcello Fontana Shop provides Consumers with information relating to the products and makes Consumers aware of the set of main characteristics of the goods offered (sizes, colors, composition, description, etc.) and the price, including taxes and duties. Furthermore, the characteristics will be visible in a photograph illustrating the offer. The Consumer acknowledges that the photograph of the product on the site has an indicative value. There may be changes due to the treatment of the photograph. All information is provided on the website www.marcellofontanashop.it in accordance with article 52 of the consumer code. Prices are indicated in Euros. The VAT imposed is the Italian VAT. A contribution to the transport costs can be invoiced (See the "Shipping" section). Marcello Fontana Shop reserves the right to modify these general conditions of sale at any time.

Acceptance of the offer

    

The acceptance and confirmation of the order are carried out by entering data in four successive phases:

1. Adding the selected products to the shopping cart

2. Indication of personal details and choice of the type of delivery

3. Selection of the payment method

4. In case of payment by credit card, the final acceptance by the Customer is made by entering his bank details (credit card number and expiry date). In case of payment by bank transfer, the final acceptance by the Customer takes place upon receipt of the transfer to the account specified at the time of confirmation. In case of payment via Paypal, the final acceptance by the Customer is made by entering the requested data on the Paypal site.

Products and prices

1. Rates

The price does not include shipping costs, billed separately from the price of the products purchased and according to the amount of the order. The shipping costs will be indicated before the order is registered by the Customer. The selling prices of the products can be modified by Marcello Fontana Shop at any time. This change will be reported to the Customer prior to the order.

2. Product characteristics

In the specific context of certain operations, "time offers" or "purchase vouchers", the discount will be divided proportionally on the value of each item.

The orders

            

Each order presupposes adherence without restrictions or reservations to these general conditions of sale. Each order made through online payment will be taken into consideration only after the acceptance of the payment by PAYPAL or crediting of the amounts to the current account of Marcello Fontana Shop Starting from the moment in which the Customer has registered the order by clicking on the button "Confirmation", consciously and without reservation accepts these general conditions of sale, the price, volumes and quantity of the products offered for sale and ordered. The customer can cancel the order through his legal right of withdrawal. The Customer's order must be confirmed by Marcello Fontana Shop through an e-mail. The sale will be considered final only after the Customer has sent this order confirmation and the full price of the same has been collected. Marcello Fontana Shop recommends the Customer to keep the information contained in the order confirmation on a paper or electronic document. Marcello Fontana Shop sells the products on its website only to retail and to final consumers. Any order manifestly not corresponding to a retail sale and, more generally, any fraudulent or alleged order, will be considered by Marcello Fontana Shop as null and void.

Confirmation and storage of the order

The order number will be communicated to the Customer following the acceptance of the transaction by the bank. The order confirmation, once accepted, will be sent to the Customer via email as soon as possible, in accordance with Article 53 of the Consumer Code. This email will contain a reminder of the items ordered, the amount paid or to be paid, the shipping costs and the order number. The invoice that will accompany the goods will indicate the right of withdrawal, the times and methods for returning the goods, the reference to which any complaints can be made. In the event that, regardless of our will, an unavailable item has been ordered, a notification of unavailability will be sent to the customer via e-mail and, in the case of payment by credit card, the refund of the amount of the missing item. will happen within 10 days.

Payment

Payment must be made at the time of the online order by the Customer or within 3 working days in case of bank transfer. At no time, the sums paid cannot be considered as installments or advances. All orders are payable in euros. To pay for the order, the customer has two payment methods: Paypal (by credit card or other cards or paypal account) and bank transfer (see details below).

PAYMENT BY CASH ON ACCOUNT

Cash on delivery takes place upon delivery of the product. Free Shipping from 150 €.

PAYMENT VIA PAYPAL ACCOUNT

If you have a Paypal account you can pay your order directly online. After choosing the payment method you will be redirected to the paypal.com website. PAYPAL is the tool that allows you to pay for an order without entering your financial data on the website www.marcellofontanashop.it. These data are in fact managed and stored in your Paypal account. By selecting this payment method, following the order confirmation, the PayPal login page will open, from where you can access your account or enter your data and complete the payment. If you do not yet have a PayPal account, you can create it directly before completing the order.

PAYMENT BY CREDIT CARD AND OTHER TYPES OF CARDS

The payment by the Customer can be made by credit card or debit and prepaid cards, a simple and safe means for online purchases through the circuit provided by PAYPAL. We guarantee our customers maximum security thanks to the most widely used encryption solution on the market. In fact, by clicking on the bank card held, the customer will be able to indicate the data of his credit card, which will be managed and stored only by the PayPal site.

PAYMENT BY BANK TRANSFER

The bank transfer allows you to pay your order within 3 working days from the date of the order: when ordering, choose "payment by bank transfer" and you will be given, after the order has been accepted, the bank details and the information to be insert in the reason for payment. ATTENTION: The shipment of an order paid by bank transfer takes place only after receiving the payment on the current account of Marcello Fontana Shop, therefore approximately 2-3 working days from the date of payment.

Shipping

The invoices / receipts are sent to the Customers together with the packages. Failure to comply with the procedures set out below implies the non-acceptance of complaints by the Customer. Marcello Fontana Shop, in addition to free collection at the headquarters, offers home delivery made by the company LICCARDI Express Courier. The Customer has the possibility to choose delivery to another address. It is sufficient to indicate the new address when placing the order. In Italy the goods are delivered in 2-3 working days *. The delivery times described are valid for orders placed from Monday to Friday by 5pm.

* For Calabria, Sardinia, Sicily and other islands the delivery requires an additional day.

Shipping costs in Italy are € 8.00 including VAT. Shipping costs will not be charged for amounts exceeding € 200.00 including VAT. For shipments outside the Italian territory, please contact us using the appropriate form on the site. Marcello Fontana Shop reserves the right to change shipping costs if the purchase relates to more than 10 items. In this case, the customer will be notified before shipping and will be able to withdraw from the order with a refund of any amounts already paid. Deliveries usually take place from Monday to Friday throughout the day. To facilitate delivery, we suggest that you indicate an address where someone is always present on weekdays. The Courier will send the Customer an email to take charge of the package to communicate the delivery date. The email will be sent to the address specified in the order confirmation phase. In the event that there is no one at the time of the first delivery, the courier will leave a notice of passage. This sheet indicates when the courier has passed and specifies that it will try to pass again in the next 48 hours. If there is still no one at home the second time, the customer will be contacted by the courier to arrange a delivery time. In any case, the customer can contact the courier by replying to the email sent to communicate the delivery date. Marcello Fontana Shop does not have the ability to manage or intervene on the information and delivery methods of the package once it has been delivered to the Courier. The Customer is therefore aware of the fact that any communication regarding non-delivery, or its modification must be made to the Courier.

Returns and Refunds

Customers not satisfied with the products received can exercise the right of withdrawal provided for in Article 64 of the Consumer Code. With Marcello Fontana Shop the Customer has 14 calendar days from the date of shipment of the products (indicated on the invoice). Within the aforementioned term, the Customer will return the goods to the Marcello Fontana store in Italy or by shipping to our Returns Service. To do this, it is sufficient to return the items intact, unused, with their original packaging, accompanied by the return voucher duly and fully completed, according to the Remote Return to the Returns Service; to obtain the refund it is necessary to communicate the details of the order and the reason for the return by email to postmaster@marcellofontanashop.it. You will then be contacted by our customer service within 2 working days to agree on the shipping methods. The refund upon receipt of the returned items and returned to our Customer Service according to the agreed methods. In case of payment via Paypal, the refund is made by crediting your Paypal account. In case of payment by credit card, the refund is made by crediting the account from which the payment of the order was made. Shipping costs are not refunded. Marcello Fontana Shop exclusively reimburses the value of the returned goods. The costs of returning the products are charged to the customer. Marcello Fontana Shop reserves the right to only accept returns that comply with all the following conditions:

1. The details of the order and of the items to be made visible in your area of ​​the website www.marcellofontanashop.it must be present in the return request email. Each garment must be returned including all original labels, packaging and accessories (case, hangers, clothes covers, etc.) received with the order.

2. The returned goods must not show signs of use or be altered in any way (worn, washed, ironed, etc ...).

3. The goods must be returned in the same condition in which they were sent and packaged appropriately.

4. The boxes of the brand for footwear and accessories are to be considered an integral part of the article itself. The latter must be unaltered and not used as external shipping boxes.

5. Returns must be shipped in the original box or other suitable, secure and properly closed box. Returned products must be sent to Marcello Fontana Shop in a single shipment, which reserves the right not to accept items from the same order, returned at different times.

The return of the garments must be received at the Marcello Fontana Shop headquarters within 10 days of the return request via email. The goods must be returned from the same country where the order was shipped. Marcello Fontana Shop reserves the right not to accept the returned goods if the return does not comply with the terms and conditions set out in the return policy. In this case, this will be communicated via email and it will be possible to choose whether to have the purchased products returned at their own expense or, otherwise, the items will be retained without refunding the relative cost.

Right of withdrawal

The Customer has the right to notify the company of his renunciation of the purchase, without penalty and without having to indicate the reason, within 14 calendar days starting the day after delivery of the package. In case of payment via Paypal, the refund is made by crediting your Paypal account. In case of payment by credit card or other cards, the refund is made by crediting the account from which the payment of the order was made. Shipping costs are not refunded. In case of payment by bank transfer, the refund is made by bank transfer to the same current account from which the transfer was received. The refund is made within one month from the date of receipt by Marcello Fontana Shop of the returned products. The costs of returning the products are charged to the customer.

Warranty - Compliance

In case of non-compliance or apparent problem of the product sent, the Customer can make a complaint via e-mail. The returned item must then be sent to the following address:
